‎The Milimani High Court has certified as urgent a petition challenging a cooperation agreement between the National Executive Government and the Nairobi City County Government.

‎Justice Bahati Mwamuye directed that the notice of motion dated February 18, 2026, be heard on priority and determined expeditiously.

‎The case was lodged by Christine Gathoni and Benard Peter against the Council of Governors, the Office of the Auditor General and 13 others.

‎The petitioners are contesting a cooperation agreement signed yesterday between the national government and Nairobi City County.

‎The applicants are also seeking certification and empanelment under Article 165(4) of the Constitution, alongside conservatory and other consequential orders.

‎In directions issued today, Justice Mwamuye ordered the petitioners to serve all respondents and interested parties immediately and file an affidavit of service by February 20.

‎The respondents and interested parties are required to enter appearance and file responses to both the application and the petition by February 27.

‎The petitioners may file a rejoinder and written submissions by March 6, while responses and rebuttals are to be exchanged by March 13.

‎The application will be heard virtually on March 16, 2026, at 10:30 a.m., by highlighting of written submissions, the court directed.
