Activists Move To Block National–Nairobi County ‘NMS-Like’ Agreement

The Milimani High Court has certified as urgent a petition challenging a cooperation agreement between the National Executive Government and the Nairobi City County Government.
Justice Bahati Mwamuye directed that the notice of motion dated February 18, 2026, be heard on priority and determined expeditiously.
The case was lodged by Christine Gathoni and Benard Peter against the Council of Governors, the Office of the Auditor General and 13 others.
The petitioners are contesting a cooperation agreement signed yesterday between the national government and Nairobi City County.
The applicants are also seeking certification and empanelment under Article 165(4) of the Constitution, alongside conservatory and other consequential orders.
In directions issued today, Justice Mwamuye ordered the petitioners to serve all respondents and interested parties immediately and file an affidavit of service by February 20.
The respondents and interested parties are required to enter appearance and file responses to both the application and the petition by February 27.
The petitioners may file a rejoinder and written submissions by March 6, while responses and rebuttals are to be exchanged by March 13.
The application will be heard virtually on March 16, 2026, at 10:30 a.m., by highlighting of written submissions, the court directed.
